1. Agreement to Terms

By visiting our website, booking an appointment, submitting medical reports, or engaging in a clinical consultation, you agree that you have read, understood, and consented to these Terms and our Privacy Policy. If you are booking on behalf of a minor or dependent, you represent that you are their legal guardian and possess the legal authority to bind them to these terms.

3. Healthcare Platform Scope & Services

Fertisure Healthcare provides comprehensive multi-specialty clinical services across Cardiology, Oncology, Orthopedics, Fertility & IVF, Obstetrics & Gynaecology, Paediatrics, and related medical disciplines.

• In-Clinic Consultations: Clinical evaluation, physical examination, diagnostic interpretations, and treatment planning conducted at our accredited medical centers.
• Teleconsultations: Remote digital consultations via secure video/audio links in accordance with the Telemedicine Practice Guidelines issued by the Medical Council of India (National Medical Commission).
• Surgical & In-Patient Care: Structured surgical pathways and in-hospital clinical interventions performed in partnership with certified tertiary hospital facilities.

4. Doctor-Patient Relationship

A formal doctor-patient relationship is established only upon the commencement of a scheduled, one-on-one clinical consultation with a licensed Fertisure specialist.

5. Teleconsultation Guidelines & Informed Consent

When participating in a remote video or audio consultation:

• Consent: By joining a teleconsultation session, you provide explicit informed consent to be evaluated remotely via audio-video technology.
• Limitations of Telemedicine: You acknowledge that remote consultations have inherent limitations due to the absence of physical tactile examination, in-person auscultation, or real-time diagnostic equipment. If the consulting doctor determines that an in-person physical examination or urgent diagnostic investigation is necessary, you agree to follow their recommendation.
• Prescriptions: Medications prescribed via teleconsultation comply strictly with List A and List B of the National Medical Commission Telemedicine Guidelines. Controlled substances (Schedule X drugs) are never prescribed remotely.
• Identity Verification: The physician reserves the right to verify the patient's identity (via government-issued photo ID) prior to initiating a clinical teleconsultation.

6. In-Clinic Appointments & Scheduling

Appointments booked online or via our helpline are confirmed based on specialist availability.

• Patients are requested to arrive 15 minutes prior to their scheduled in-clinic appointment slot to complete registration and vital sign recording.
• While we make every effort to adhere strictly to appointment schedules, clinical emergencies or complex procedures may occasionally cause delays. We appreciate your patience and understanding in such circumstances.

7. Patient Responsibilities & Medical History Disclosure

To ensure safe and optimal medical outcomes, you agree to:

• Provide complete, truthful, and accurate medical history, including ongoing medications, allergies, previous surgeries, and concurrent treatments.
• Notify the physician immediately of any adverse reactions or unforeseen changes in symptoms following a consultation.
• Refrain from recording, reproducing, or publishing audio/video sessions or doctor communications without prior explicit written authorization.
• Treat all medical practitioners, nursing staff, and administrative personnel with dignity and mutual respect.

8. Fees, Billing & Payment Policies

Consultation fees, procedural charges, and diagnostic packages are clearly communicated prior to confirmation.

• Payment Methods: We accept online payments via UPI, Credit/Debit cards, Net Banking, and in-clinic cash/POS transactions.
• Taxes: All fees are subject to applicable statutory taxes and regulatory healthcare levies.
• Refunds & Cancellations: Cancellation and refund requests are governed by our dedicated Refund & Cancellation Policy.

9. Intellectual Property & Website Content

All content on this website—including the Fertisure logo, brand name, trademark slogans ("Your Partner in Healthcare"), clinical illustrations, medical copywriting, code, and graphical layouts—is the exclusive intellectual property of Fertisure Healthcare and protected under Indian Copyright and Trademark laws. Unauthorized reproduction, scraping, or commercial exploitation is strictly prohibited.

10. Limitation of Liability

To the maximum extent permitted by applicable Indian law, Fertisure Healthcare, its medical directors, specialists, and affiliated staff shall not be liable for any indirect, incidental, or consequential damages resulting from:

• Inaccurate or incomplete medical history provided by the patient or their attendant.
• Failure of the patient to follow prescribed treatment protocols, dosage instructions, or recommended follow-up appointments.
• Internet connectivity disruptions, third-party software interruptions, or telecommunication failures during remote video consultations.

11. Governing Law & Dispute Resolution

These Terms and all clinical interactions shall be governed by and construed in accordance with the laws of the Republic of India. Any legal dispute, claim, or controversy arising out of or relating to these terms or our medical services shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, India.
